Expedited Hearings Process for ESD Unemployment Insurance Caseload

1.    An expedited hearing may be requested by a person with an urgent financial hardship.  An urgent financial hardship means that you cannot meet basic needs necessary for living, working, or seeking work.

2.    You must submit evidence to the Office of Administrative Hearings (OAH) along with the expedited hearing request form.  Examples of appropriate evidence/documentation include, overdue bills for necessities of life i.e. rent, utilities, or a notice of eviction.

3.    You must submit the evidence through the OAH participant portal https://secureaccess.wa.gov/ or by fax at (509) 456-3980.  If you need help with the Participant Portal, please call our Call Center at (800) 583-8271 or visit our Manage My Case page.

4.    The administrative law judge (ALJ) will decide to grant or deny your request for an expedited hearing. Not all requests for an expedited hearing will be granted.  A request will be granted only if the ALJ finds that you have an urgent financial hardship. There is no right to appeal an ALJ's decision to grant or deny an expedited hearing request.

5.    After you submit your request, OAH will contact you within 4 business days with a decision.  Please do not contact OAH unless it has been more than 4 days since you submitted your request.  If it has been more than 4 days, you can check the status by calling our Call Center at (800) 583-8271.

6.    If the ALJ grants the request for an expedited hearing, OAH will schedule a hearing and notice will be provided to you as soon as possible.

7.    If the ALJ denies the expedited hearing request, OAH will schedule the hearing as usual.
