What happens at a prehearing conference?
The prehearing conference is by phone. It can last from 30 minutes to 2 hours.
The parties and the judge will discuss:
- What will happen at the hearing
- The issues that will be discussed at the hearing
- How much time is needed for the hearing
- When everyone (including witnesses) are available for the hearing
- Hearing date, time and location
- Witnesses and documents
- Any questions you have
At the prehearing you will not:
- Present your case to the judge
- Present any documents
- Need any witnesses
What happens if I do not attend the prehearing conference?
If you asked for the hearing, you must participate in the prehearing conference. Otherwise, your case may be cancelled (dismissed).
How do I participate?
You will receive a Scheduling Notice. It will tell you how to participate. Here is an example - Scheduling Notice. If you have questions call 800-583-8271 or email oah.ospi@oah.wa.gov.
- If using a cell phone, make sure the battery is fully charged.
- You need to have good, clear reception. The judge must be able to hear you.
- Be in a quiet location.
- Do not drive during the prehearing conference.
- Do not multitask. The judge will expect your full attention.
What is a Prehearing Order?
After the prehearing conference, you will receive a Prehearing Order. The order lists all of the due dates and the hearing date, time and location. It will have a statement of the issues for the hearing.
It is very important to read all of the Prehearing Order.
